CJM awards 2 years imprisonment to truck driver for killing one, injuring another

CJM Jammu Suneet Gupta awarded 2 years imprisonment to Maqbool Ahmed son of Shukar Din, resident of Jagti, Nagrota who was facing trial for the last 15 years in accident death case.
Prosecution story in brief is that on December 23, 2001 Incharge Police Post Nehru Market namely Zamroodh Hussain Sub- Inspector entered a report in the Roznamcha of Police Post Nehru Market during Patrolling he had apprehended the present accused Maqbool Ahmed son of Shukar Din resident of Jagti Nagrota , who happened to be the Conductor of Truck bearing No: JK02G/5929 and was not holding a valid driving license to drive the Vehicle. He had further reported that today the aforesaid Maqbool Ahmed without any authority was driving the Truck from Sidhra and he had not stopped the Vehicle at Sidhra police check post , when he was signaled to do so and after breaking the police naka he in a rash and negligent manner drove the vehicle towards Jammu City .
The Flying Squad No: 7, Flying Squad No: 13, Flying Squad No: 6 and Flying Squad No: 2 had repeatedly asked him to stop the vehicle , but he had not complied with the direction of the Flying Squads and proceeded towards Bikram Chowk and at about 9:30 P.M in the evening he turned his vehicle towards University road and rammed over a Scooter bearing No: JK02C/8547 which was coming from opposite direction on its right side and in the resultant there of two persons namely Mohd Yasin son of Mohd Ismail and Om Parkash son of Chatru Ram , who were riding on the said Scooter had received serious injuries . One of the person namely Mohd Yaseen was died on the spot and another one had received serious injuries , who was taken to the hospital .
CJM Jammu after hearing of the considered court is of opinion that the prosecution has been sufficiently able to prove the offences under sections 304A RPC and 337 RPC against the accused .As such, the accused is convicted for the aforesaid offences . He shall undergo a simple imprisonment for two years and also liable to pay the fine amounting to Rs.2000/- for the commission of offence Under Section 304-A RPC and in default of payment of fine amount , the accused shall further undergo a simple imprisonment for one month. Further the accused is also ordered to undergo a simple imprisonment for one month for the commission of offence under section 337 RPC. However, both the sentences shall run concurrently.
