Special Mobile Magistrate Electricity Batote Abdul Nasir awarded 3 years imprisonment to truck driver namely Mohd Fariaz who was challaned by the police in 304-A/279/337 RPC. Facts of this case are that on 15-07-2013 information from reliable so received by the police station Chanderkote to the effect that one truck bearing No. jko2f 0427 driven by Mohd Fariaz son of Mohd Hussain R/o Hayat Pora Tehsil and District Rajouri from Jammu towards Srinagar in a high speed manner at about 3.40 am lost control over the vehicle due to the speed of the truck a CRPF 54th Bn vehicle No ChIOL-1258 coming from the opposite side was taking CRPF personnel for ROP duty. Constable Rama Shankar 0017 and constable Ashim pal No. 103530526 died on spot due whereas one constable was caused due to the rash and negligent manner speed the decreased and the injured had been shifted to Hospital Ramban Police Lodge FIR and conducted investigation and seized the Vehicle Post Morterm report and medical reports were collected by the IO etc were prepared Accused was found involved in the commission of the 279/337/304-A RPC and hence this Challan.
Special Mobile Magistrate Electricity Batote Abdul Nasir after hearing both the sides observed that ourt is of the opinion that the guilt of the accused for offences u/s 279/337/304-A RPC stands proved beyond all reasonable doubts. Offender is, therefore convicted for the commission of offences u/s 279/3337/304-A RPC and sentenced to punishment with simple imprisonment for a period of six months and a fine of Rs. 1000/- for offence u/s 279 RPC, Punishment of simple imprisonment for six months and a fine of Rs. 500/- for offence u/s 337 RPC and punishment with simple imprisonement for a term of 03 years and a fine of Rs. 3000/- for offence u/s 304-A RPC. In case of failure to pay the amount of fine of Rs. 4500/- the convict shall further undergo simple imprisonement of one month. All the sentenced shall run
Convict/offender is arrested and sent to judicial custody at District Jail Udhampur for execution of term of sentence passed against him. —JNF
