Jammu Tawi, January 2

3rd Additional Sessions Judge Jammu Kishore Kumar rejected the bail application of one Ashfaq Ahmed Khan who is advocate by profession and was allegedly booked by the police in rape case.

According to the police case that a written report in the police station stating therein that one man namely Ishfaq Ahmed met her in a house near Tiny Tots School, Sainik Colony, Jammu, he raped her there and gave her a threat of life in case she will disclosed the matter to anybody. On this report  FIR  No. 105/2016 for the commission of offences under sections 376, 342 RPC has been registered and investigation started.

After hearing both the sides, 3rd Additional Sessions Judge Jammu Kishore Kumar observed that APP has argued that the Advocates are the role model of the society and he has committed a very heinous offence which carries punishment of more than 10 years or upto life imprisonment. To grant the bail to an Advocate will definitely demoralize the prosecution witnesses and the confidence of the public at large will be shattered. I am in agreement with the submission of the APP that Advocates are the role model of the society and owes a high responsibility in the society and plays a very vital role for the betterment of the society. The grant of bail in this case may shaken the confidence of the society in the criminal judicial system. With these observations court rejected the bail application. JNF
