Fast Track Court rejects bail in rape case

Presiding Officer Fast Track Court Kishore Kumar rejected the bail application of one Rohit Sharma son of Davinder Kumar Sharma resident of Rajpura.
The prosecution story in brief is that about more than one year back, accused lured the prosecutrix and under false promise of marriage he used to have sexual intercourse with her, against her consent. Even accused under the said promise of marriage used to call her in his house and used to commit rape on her and due to the said act of accused she had conceived twice and accused had got her abortion conducted in a private clinic at Toph Sherkhania.
It is further alleged that on May 12, 2015 in the afternoon, accused had called her in his home, while he was alone there and had again committed rape on her and threatened her not to come again in his home and also to go away from his life. Accordingly, prosecutrix had lodged complaint on June 16, 2015 in Police Station Bakshi Nagar against the accused and an FIR No: 59/2015 for offences under sections 376/506 RPC came to be registered for the commission of offences under sections 376,420,506 RPC and after the completion of investigation, challan was presented in the court of law.
Court after hearing both the sides observed that in view of the recent incidents of crime against women, particularly, incident of rape of minor, the courts have already sounded that precaution is to be taken by considering the bail please of the offenders of such heinous crime. It has been impressed upon the Judicial officers and Sessions Judges dealing with such cases to take care and caution in exercising discretion to consider their release or otherwise of accused on bail pending investigation and trial, lest the discretion so exercised adverse the societal interests, investigation and fair play for fair trial”. With these observations court rejected the bail
