HC bans constructions in Gulmarg

The State High Court today ordered ban on constructions in famous ski resort of Gulmarg in North Kashmir after reports of illegal constructions.
The Division Bench of High Court comprising Justice MH Attar and Justice Ali Mohammad Magrey directed that all constructional activities in Gulamarg are stopped. “Deputy Commissioner as also Senior Superintendent of Police Baramulla and Gulmarg Development Authority shall forthwith enforce the above direction and ensure no constructional activities is undertaken at Gulmarg till further orders from the court”,  directed the Bench.
Court made in clear that if any person violates the court direction and continues with the constructional activities, then authorities shall seal such structure.  “That no building material or constructional material shall be transported to the Ski resort till further orders from the court”, directed the bench.
The direction regarding ban on construction and transportation of construction material has been passed in lieu of serious allegation made in the status report which prima facie projected grave irregularities committed in allowing the people to renovate and repair their structures.
Court observed that the situation which has arisen in and around the famous Ski resort by allowing the constructional activities without proper permission and Gulmarg Development Authorities has granted permission for transportation of constructional material as no permission for renovation or repairs has been granted in accordance with law.
Court in such situation directed transfer of Assistant Executive Engineer of GDA immediately. “We deem it proper to ask the Government to immediately shift the AEE posted in GDA and post another person in his place. We expect that order in this behalf be passed in week’s time”, court said.
Court expressed serious concern and displeasure over the attitude of Gulmarg Development Authority by allowing the constructional material to Gulmarg without granting permission for raising of construction or for effecting repairs and renovations of the structures.
Court directed the Principal District Judge Anantnag who has been appointed as Court Commissioner  to visit the Gulmarg and inspect all the structures which have already been inspected by him earlier and submit his detailed report indicating therein, whether the recommendation made by him have been complied with no deviations have been made.
“Deviations, if any, shall be recorded by him in his report and copy thereof shall be supplied to CEO Gulmarg, besides filing report in this behalf before the Registrar Judicial”, reads the order.
Court said the Joint Registrar of High Court to assist the Court Commissioner in conducting fresh inspection and asked both the officials to visit the Gulmarg on non-working days or holidays.
Court said that all the interested persons and the authorities of CEO Gulmarg shall remain present at the respective sites at the time of inspection by the Court Commissioner as and when the date of visit by the Court Commissioner shall be notified through CEO Gulmarg.
Court directed those persons who have filed application for spot inspection by the Court Commissioner for his recommendation with regard to the construction of their structures to deposit Rs 10000 each with the Registrar Judicial of this court within a period of one week.
Court also provided that all those vehicles shall be seized which they find transporting constructional material towards Gulmarg.
