HC directs SHO P/S Gandhi Nagar to file fresh status report

Justice BS Walia of J&K High Court Jammu Wing in a habeous Corpus Petition directed the Station Head Officer,Gandhi Nagar to file fresh status report in missing of girl since 2014.
The Habeous Corpus Petition was filed by Sabia mother of the girl who is missing from her grand Father residence since August 2014.Counsel for Petitioner Advocate Aditya Sharma pleaded before the Justice B S Walia that daughter of the Petitioner is missing since August 2014 and her whereabouts are not known till today. Justice Walia directed the SHO Concerned to appear in person and tell the exact position of the case. SHO, Gandhi Nagar appeared in person and disclosed that efforts were made but they are not able to succeed in tracing out the girl. Advocate Aditya Sharma further pleaded that the Petitioner is having the apprehension that her daughter might have been murdered and burried in the residence of the Pvt. Respondent upon which a religious structure has been raised at Nai Basti. Advocate Aditya Sharma alleged that the religious structure had came into being only after the missing of the daughter of the Petitioner and it was not there until August 2014. He further alleged that a direction was issued by the Court on 2nd of Septmeber,2016 to file status report and since then petitioner had been continuously receiving the threats from the Pvt. Respondents and are forcing her to withdraw the case else she will face the consequences.
Justice B.S.Walia directed the SHO Concerned to conduct the enquiry and take help of the Wakf board as well and file the fresh status report with respect to the existence of the Religious structure at the residence of the Pvt. Respondent within the period of six weeks and matter be again listed in the week commencing 26th of December,2016. JNF
