HC stays preliminary enquiry by Vigilance against JU

Justice B S Walia of J&K High Court today kept in abeyance the preliminary enquiry initiated by VOJ against Jammu University regarding books purchase.
While staying the preliminary enquiry against Jammu University, Justice BS Walia after hearing Adv Anil Sethi observed that counsel for the petitioner states that on a complaint filed by one Narinder Singh Raina, General Secretary, National Secular Forum, Sarwal Jammu against the Authorities of Jammu University, J&K State Vigilance Commission vide detailed order dated 01.02.2017 in a complaint No.925/2015 came to the conclusion that the allegations made by the complainant were baseless, wrong and not based on true facts. Justice BS Walia further observed that counsel for the Jammu University further contended that now the Vigilance Organization has instituted an enquiry into the matter which is based on identical allegations which were the subject matter of complaint No.925/2015 which as noted above was dismissed on the ground of the same being baseless and not based on true facts. During the course of hearing Adv Anil Sethi submitted that the enquiry by the Vigilance Organization has been manipulated by one of its officials who harboured hostilities against the University on account of his wife not being accommodated in the University despite her not being entitled for the same. The aforementioned official and his wife are not parties in the instant writ petition and seek permission to array them as respondents.Justice BS Walia permitted to do so in the presence of Reader of this Court and issued notice to them and ordered that subject to objections from other sides the enquiry initiated by the Vigilance Organization Jammu shall remain in abeyance till the next date only and subject to filing of objections by the other side.
