High Court directs Secretary, GAD to appear in person

Non-Compliance of Court judgment in 2009 KAS batch

In a contempt petition filed by Hoshiar Chand and another seeking implementation of judgment passed on April 1, 2016 in 2009 KAS batch in which High Court allowed the petition by directing respondents by issue of a writ of mandamus to accord consideration to the case of the petitioner for his selection and appointment against a post having remained unfilled or rendered vacant under ALC category due to non-joining of any candidate. This exercise must be completed without any delay, preferably, within six weeks period.
Justice Janak Raj Kotwal after hearing Adv Aparajita Jamwal for the petitioners, observed that no representation on behalf of the respondents nor compliance report/statement of facts have been filed. Learned counsel for the petitioners states that judgment of this Court has not been complied with till date. Counsel for petitioners also states that petitioners have no information about filing of LPA against this judgment of this Court.
Justice JR Kotwal further observed that as respondents have not filed the compliance report/statement of facts nor there is any representation on their behalf and the judgment of this Court passed far back in April, 2016 is stated not to have been implemented, directed Administrative Secretary General Administration Department, Government of J&K, shall remain present in person on the next date to assist the Court.
