MLA terms SROs to be illegal

MLA Udhampur, Pawan Kumar Gupta today assailed the SROs no 360, 361 and 362 by terming to be illegal, arbitrary and discriminatory and also to be in sheer violation of the constitution, law of the land motivated intentionally to benefit the law breakers with colourable exercise of power without involving any public interests. In a press conference held here today wherein, MLA said that the state government in issuance of said three SROs dated November 13, 2016 has created class discrimination between honest tax payers and tax evaders quite in contrary to the mandate of the constitution which protects the honest not the dishonest by rewarding the tax evaders who are habitual in tax evasions and defaults admittedly well before from the accounting year 2004-05and have willfully failed to avail the amnesty granted to them a period back in the year 2007.
Gupta said that the government has shown its inability to the tax imposed on helicopter service deployed on various pilgrimages including Shri Mata Vaishno Devi but on the other hand it has helped the law breakers with its illegal, mala-fide extraneous considerations with colourable exercise of powers which is neither permissible under the constitutional provisions nor under the section 25-D of J&K GST Act.
He reminded that the matter remained in litigation before the High Court where the state was reprimanded on numerous occasions for not recovering the due arrears of tax collected by various dealers from the consumers and failed to deposit in the government treasury, however at last at the instance of the government, the High Court allowed the state government to grant amnesty to the extent of wavier of penalty subject to the deposit of principal tax along with internet.
