DB directs petitioner to approach Govt

In a Public Interest Litigation filed by ‘Voice of Rights’, an NGO seeking direction to the respondents to appoint the Chairman and the Members of State Human Rights Commission, New Rehari, Jammu which is headless since October, 2011 and the Members have retired with a further direction to the respondents to establish the sub offices of State Human Rights Commission in all the Districts of the State as per J&K Protection of Human Rights Act.
Division Bench of State High Court Comprising Chief Justice N Paul Vasanthakumar and Justice Tashi Rabstan after hearing Sr. AAG Seema Shekhar appearing for the state, disposed of the PIL with the observation that insofar as the prayer is concerned, the Chairman and Members of State Human Rights Commission have already been appointed and they are in office, therefore, the said prayer has rendered infructuous.
Division Bench further observed that insofar as the prayer for opening of Sub Offices of Human Right Comission is concerned, if the petitioner is interested in pursuing further, it is open to the petitioner to approach the State Government for this purpose. JNF
