Jammu Development Authority lodged an FIR against the Management of Golf Course Sidhra for restraining the JDA team to perform their official duty.
Tehsildar Executive Magistrate Ist Class, JDA, during the visit to the Golf Course found that an unauthorized construction has been carried out in violation of Control of Building Permission Act-1988.The management was verbally directed to stop the construction and produce relevant papers.
However, the management continued with construction and on Thursday when the JDA team headed by Tehsildar, visited the Golf Course to inspect, was stopped at the entrance itself.
Seeking registration of FIR under Sections 114,119, 120B, 175,183,186,187,188 and 202 of RPC and Section-6 and 12 of Control of Building Permission Act-1988, the Tehsildar lodged a written complaint with Police Post Sidhra which read as:
It is intimated that Jammu Development Authority is authorised agency to implement Jammu Master Plan and is authorised under BOCA to regulate any construction under its jurisdiction. The undersigned as Tehsildar Executive Magistrate 1st Class, JDA is an authorised officer of JDA to enter in the premises to regulate the construction as per law. The beneficiary has to produce the title of land and also sanction building permission to the undersigned regulating authority on enquiry.
As such, undersigned on 6/12/2017 and 07/12/2017 visited village Sidhra (Golf Course Sidhra) and found unauthorised construction which was being carved out by the Management of Golf Course Sidhra for some building without getting any building permission from competent authority. It was also without any proper title of land. They were verbally directed to stop the construction and produce relevant papers.
However, defying the instructions, the said person for abetting the offence, have today stopped the undersigned at the main gate and did not allow to enter the premises in order to continue with the illegal construction by the Gate Keeper of Golf Course Amit Kumar S/o Shri Ram Paul R/o Bajalta on the instruction of Shri Manav Gupta, Secretary Golf Course. The undersigned even disclose identity and showed my Service Identity Card, that undersigned as a Government employee is on duty and intends to perform the legitimate duty but the two persons did not allow and forcibly stopped the undersigned to enter and inspect the area of construction in question.
Then the undersigned reached the site of construction by taking some outer way and found that the illegal construction was going on with full swing. The two persons did not stop and forcibly restrained the JDA team to perform official duty.
As such, both have committed offence under Section 114, 119, 120B, 175, 183, 186, 187, 188, 202 and Section 6 and 12 of Control of Building Permission Act, 1988. It is requested to lodge FIR against the above said offender under relevant section.”
