The court today extended 11 days’ judicial remand of Pak national Mohd Naveed alias Usman and 3 others allegedly involved in attack on a BSF convoy in Udhampur.
In a much publicized Udhampur attack case, in which a Pak national Mohd Naveed alias Usman was arrested by the police, Special Judge NIA, YP Kotwal after hearing Special PP for NIA, extended 11 days Judicial remand of Mohd Naveed alias Usman, son of Mohd Yaqoob, resident of Kukianwala, Rafiq Colony, P.S. Ghulam Mohammed Abad, District Faisalabad, Punjab, Pakistan, Khursheed Ahmed Bhat, son of Gulam Mohammed Bhat, resident of Bhatpora, Chursoo, Awantipora, Pulwama, Showkat Ahmed Bhat, son of Ali Mohd Bhat, resident of Village Khardermuh, PS and District Pulwama, J&K, and Shabzar Ahmed Bhat, son of Abdul Rashid Bhat, resident of Nai Basti, Gulshan Abad, Quimoh, Police Station, Kulgam, District Kulgam (J&K).
The CD file revealed that accused Mohd. Naveed alias Usman was arrested by J&K Police on 05.08.2015, Khursheed Ahmed Bhat was arrested by NIA on 21.08.2015, Showkat Ahmed Bhat was arrested on 02.09.2015 and accused Shabzar Ahmed was arrested on 13.10.2015.
Perusal of CD file further revealed that above mentioned accused persons were remanded to judicial custody beyond the period of 90 days.
Perusal of the CD file further revealed that the investigation of the case is in progress and some of the accused persons involved in the case are still absconding which is causing difficulties in un-earthing the larger conspiracy behind the attack on BSF convoy.
Perusal of the CD file further revealed that efforts are on for the arrest of absconding accused and to collect more evidence to finalize the investigation of the case.
At this stage, accused Mohd Naveed submitted in the court that jail authorities have kept him in a cell, his continuous lodgment in the said cell is causing mental tension and hardship to him.
He also submitted that warm clothes be provided to him. Ld. Counsel appearing on behalf of the accused Naveed also urged that warm clothes be provided to the accused, and instead of cell, he should be lodged at some other suitable place. However, Special PP submitted that the accused has been lodged in the alleged cell because of threat to the life of the accused.
After hearing, Special Judge, NIA, YP Kotwal ordered that all the four accused be remanded to judicial custody for a further period of another 11 days from today i.e. upto 28th of November, 2015.
Superintendent of the jail shall lodge the accused Naveed at some other suitable place if practicable instead of the alleged cell as per the Jail Manual, warm clothes be also provided to him, and medical examination of the accused be got conducted after every 48 hours, the court further ordered.
