HC grants pre-arrest bail to Veterinary Doc in attempt to murder case

Jammu: Jammu Kashmir and Ladakh High Court has granted pre-arrest bail to a Veterinary Doctor in an attempt to murder case. Justice Vinod Chatterji Koul of Jammu & Kashmir and Ladakh High Court after hearing Advocate Aseem Sawhney appearing for the applicant Shabnam Mustafa observed that having regard to the fact that the other co-accused involved in the case had already been admitted to bail in the impugned FIR and the applicant is a government servant i.e. doctor by profession which can be a reason to believe that he will not abscond.
As such, prima-facie case is made out for grant of bail in anticipation of his arrest in favour of the applicant at this stage, issue notice, returnable within three weeks, subject to filing of requisites within one week.
Meanwhile, subject to objections from the other side and till next date of hearing, it is ordered that in the event of arrest of the applicant in FIR No. 90/2023 registered with Police Station Thana Mandi, Rajouri for the commission of offences punishable under Sections 307/147/323 IPC and Section 438 CrPC, he shall be released on interim bail on his furnishing of bail and personal bond in the sum of Rs 100,000 each to the satisfaction of the arresting officer. This order shall however, be subject to the conditions.
